AMERICAN WAREHOUSE TERMS AND CONDITIONS
These Terms and Conditions (“Terms”) together with the terms set out in the Privacy Policy govern the use of any applications or services owned or controlled by American Warehouse GOL LLC (“Company”).
Company provides online and mobile application services (“Services”), which allows users to create unique personal profiles as well as generate personal events and activities designed to facilitate communications with other members based on geographic location. By accessing or using Company’s Services you agree with the Terms hereto.
Agreement to Terms of Use
By accessing or using the Services you agree (1) that you have read, understand, and agree to be bound by the terms and conditions in this Agreement (2) you represent and warrant that you are of legal age and not prohibited in any way by law or otherwise from accessing or using this Service. If you do not understand or agree to any term or condition in this Agreement you must immediately cease use of our Services and will have no right to access or use our Services in the future unless you have agreed to be bound by these Terms. Accordingly, service will be void where prohibited.
Modification of Terms of Use
We may modify these Terms at any time and with in our sole discretion. If the Terms are modified then we will notify you of any changes by either posting the modified Terms on the website or mobile application. Please refer to these terms periodically in the event these Terms have changed. If you continue to use our Services after the Terms have been modified then you are agreeing to be bound by the modified Terms. If you do not understand or agree to be bound by these terms then you must immediately cease use of the Services whereupon your sole recourse shall be to cease using our Services. You agree that Company will not be liable to you or any other third party for any change or modification to these terms.

We do not discriminate on the basis of age, race, disability, national origin, gender, sexual orientation or religion
No part of the Company is directed to persons under the age of 13. Accordingly, you must be at least 13 years of age or have accessed our services under the consent and supervision of someone 18 years and older. Use of this site shall be deemed as a representation that the user meets the eligibility requirements set forth in these Terms.
If use of our services occurs outside of the United States then you are responsible for complying with the laws and regulations of the territory in which you are accessing or using our services.
Creating an account with American Warehouse
To access and use our Services, you may register and create an account to customize your user experience. An account can be created by signing in under the My Account page whereupon when prompted a user must enter information, which will uniquely identify themselves on our database by providing their name, address, shipping address and payment information. Any and all information collected will not be used for any unauthorized or illegal purposes by our employees, managers, or officers. The more information that is provided the more enhanced the user experience will be. Reasonable and timely safety precautions will be taken to ensure the safety of this information is stored safely.
Content Ownership Rights
Content means any text, graphics, images, music, audio, video, software and any other materials that are posted, generated or generally made available while using our Services. Company and its licensors exclusively own all right, title and interest in and to the Services and Content, including all associated intellectual property rights. You acknowledge that the Services and Content offered by Company are protected by copyright and trademark laws whereupon you agree not to remove, alter or infringe upon any copyright, trademark, service mark or accompanying Services or Content.

Company is not responsible for the content or use of any unaffiliated Web Sites or services that may be linked to or from these Sites. There is no assumption that we endorse, condone or accept the responsibility for such content on these sites and not event, promotion or reference to a third party product or service shall be construed as an approval or an endorsement of its services. These links are provided to improve the user experience by directing you to other products or services that may be of interest to you and are for your convenience only. Access to Personal Information
Any personal information communicated to Company that is stored by Company and its agents will be available to Company for the purposes of operating our Services, assisting third party contractors in their operation and support of our services and may be transferred by us as part of a transaction whereby we will transfer all or part of our business, in which personal information held by us about our customers will be one of the transferred assets. We may also retain your information for compliance purposes such as is required or permitted by law, regulation or order, including to the police or other appropriate authorities, to investigate complaints made by or against you, or to protect or defend ourselves, or others against illegal, criminal or harmful activities.
Rules and Regulations
You agree to use our Services in accordance with the Terms set forth above as well comply with our rules and regulations, which require the members not to interfere or disrupt the Services or servers or networks connected to Services, interfere or disrupt with any of the Services security features, intentionally or unintentionally violate any applicable local, state, national or international law, use Services to harm minors, to promote discrimination, harassment, bigotry or threat of physical harm against other users. You also agree to not promote, communicate or engage in any activities or actions, which encourage false, misleading or illegal activities, exploits people in a sexual or violent manner, illicit sex or illegal substances, If you fail to comply with these Rules and Regulations then Company reserves the right to terminate your account and use of our services. Company also reserves the right to access your personal information if operating under a good faith belief that you have failed to comply with these Rules and Regulations. We may also access your personal information to enforce the Rules and Regulations of this Agreement as well as to protect the rights, property or personal safety of Company and its agents.
Product and Services Information
All of the products offered on this site are through a third party distributor (“Supplier”) that the Company has contracted with to provide the products listed at the advertised price. Inventory is constantly changing and will be reasonably updated to reflect products that are or are no longer available. Accordingly, price and availability is subject to change with out notice.
The product dimensions, specifications, and characteristics displayed on this site are represented in an accurate manner based on the information provided to us by the Supplier, and the Company is not responsible in the event some of this information has become out dated or is no longer accurate. If an item is not accurately represented on the site and the Company has no reasonable notice or knowledge of this inaccuracy, then the Company will work on the customer’s behalf to ensure that the correct product is ordered through the supplier, and if there are no similar products available that the items are returned and a refund is requested from the supplier. Please be aware that product’s size, shape and color may look different in real life.
Receipt of an email order confirmation is simply recognition that the Company has received your requested order and does not constitute an offer to sell. We reserve the right to limit the quantity of any item sold or prohibit a sale altogether, while also reserving the right to terminate the order before it has been processed.
Liability Limitations
Company and its partners, employees, or agents will not be liable for any incidental, special, exemplary, punitive, or consequential damages, including lost profits, loss of date or goodwill, service interruption, computer damage or failure or the cost of substitute services arising out of the use of our Services or Products.
To the maximum extent allowed by applicable law, Company provides that the Service is on an “as is” and “as available” basis and grants no warranties of any kind, whether express, implied, statutory or otherwise with respect to our Services, including all content contained therein, including, but not limited to, any implied warranties of satisfactory quality, merchantability, fitness for a particular purpose or non-infringement. Company does not represent that the service will be uninterrupted or error free, secure or that any defects or errors in the service will be corrected and does not warrant that any of the information accessible on this site is accurate, complete or current.
The Company makes no representations or warrantees that the site will be uninterrupted or error free, or that all defects will be corrected including but not limited to, warranties of title, implied warrantees of merchantability or fitness for a particular purpose. You shall agree to use this site at your sole risk.
Company shall not be held liable for any damage resulting from loss of use, date, or profits, including but not limited to contract, negligence or other tortious actions arising out of or in connection with the use, contents, copying of this site.

Typographical Errors
Company will make every effort possible to ensure that all text on this site is free of any typographical errors; however, in the event there is a typographical error then Company at its sole discretion can either correct the error or contact you to notify you if the error has materially impacted your order or use of the site. Company reserves the right to correct any errors, inaccuracies or omissions, before or after an order has been placed regardless of when payment for the order has been processed.
Termination
Company at any time reserves the right to terminate your use of its services for any reason, including but not limited too, your breach of these Terms. If you are unsatisfied with your use of this site then your sole remedy or recourse of action is to immediately terminate your use of this site and Company’s services.

Charges
You are responsible for payment of any costs or expenses incurred as a result of using our Services, including any operator network or roaming charges if viewed on a mobile device.
Reverse Engineering
You agree not to disassemble, de-compile, reverse engineer, or otherwise attempt to gain access to the source code related to our Services. You will not copy any part of our Services or make commercial use, rent, lease, loan, sell, publish, license, sublicense, distribute, assign or otherwise transfer any part of our Services to a third party.
Rule of Law
This Agreement is entered in to in Los Angeles County, California, effective immediately, by and between American Warehouse, a California, limited liability company, and you the user. This agreement shall be governed by, construed and enforced in accordance with the laws of the State of California. Any and all claims or disputes between the Parties hereto arising out of, or in any manner concerning this Agreement or a Transaction shall be decided by binding arbitration. The prevailing Party in such arbitration shall be entitled to recover its costs and reasonable attorneys’ fees from the other Party.
Entire Agreement
The parties hereto agree that this Agreement may not be modified, altered, or changed except by a written agreement signed by both parties hereto. The parties acknowledge that this constitutes the entire agreement between them superseding all prior written and oral agreements, and that there are no other understandings or agreements, written or oral, among them on the subject. If any provision of this Agreement is held to be invalid, the remaining provisions shall remain in full force and effect.
